Terms & Conditions

We, Sun Tours, referred to as the Company, with registered address at 71 Chudleigh Road, Plumstead 7780, Cape Town, South Africa, accept bookings subject to the following conditions.

1. How to Book

On receipt of your signed reservation form and a deposit of 10 % of the package price, we will, subject to availability, reserve your place on your selected tour. When we send your confirmation invoice to you, or the agent through whom you booked, your booking is confirmed and accepted by us. The balance of the payment is due to Sun Tours not later than 56 days prior to departure. By failing to pay the balance by this date, you will forfeit your deposit. On receipt of your full payment, we will send our essential information guide. Please ensure that you have this information before you leave for your tour.

2. Cancellation

Cancellation of your booking must be made in writing. Cancellations are only effective on receipt of written notification. If cancellation is made within 56 days before departure, your deposit will be forfeited. If your cancellation is made after the full payment is made, charges will be levied. The scale of charges, expressed as a percentage of the package price is as follows:

More than 56 days notice-loss of deposit only

56 - 43 days notice  – 30%

42 - 29 days – 50 %

28 - 15 days – 75 %

14 days or less  –100%

Should you fail to join the tour, or join the tour after departure or leave it prior to its completion, no tour fare refund can be made. (Please note that if that if the reason for cancellation falls within the terms of any holiday insurance policy which you hold, then such charges will normally be refunded to you by the insurance company, subject to the terms of your insurance).

3. Booking Changes

If you change your confirmed booking to an alternative departure date, you may do so subject to availability by paying a transfer fee of ZAR 750. Where the transfer is made within 56 days of departure, the normal cancellation scale of charges shall apply, unless transfer is to an earlier departure of the same tour, in which case only the transfer fee will be charged.

 

4. Baggage

Passengers are permitted one soft-type travel bag of 20 kg maximum. Limitations must be adhered to. This excludes camera equipment bag or similar, within reason.

5. Passport and Visas   

Sun Tours cannot accept any responsibility for persons who are denied entry to South Africa as a result of passport or visa associated problems. You are responsible for all travel arrangements and costs to the point of commencement and from the point of conclusion of the tour.

6. Wild  Animals

Please be aware that these tours may take you into close contact with wild animals. Attacks by wild animals are rare, but no tour in the African wilderness can guarantee that this will not occur. Neither the company nor their employees, nor agents can be held responsible for any injury or incident on the tour.

7. Health

Anti-malaria precautions should be taken and commenced prior to departure and clients should bring their own insect repellent as this is not included. If you are a contagious disease carrier, you must let us know when making your booking. Please consult your doctor for specific advice.

8. Responsibility

Neither the company nor any person acting for, or on the behalf of the Company shall be liable for any loss or damage whatsoever arising from any cause whatsoever and without restricting the generality of the aforegoing shall particularly not be responsible for loss or damage arising from any errors or omissions contained in its brochure or any other literature, late or non-confirmation or acceptance of bookings, loss or damage caused by delays, sickness, injury or death, whether occasioned by negligence or not.

In addition the Company shall have the right at any time, at its discretion to cancel any tour or the remainder thereof or make any alteration in route, accommodation, price or other details and in the event of any tour being rendered impossible, illegal or inadvisable by force majeure (war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather), or any other cause whatsoever, the extra expenses incurred as a result thereof shall be the responsibility of the passenger.

The Company may at its discretion and without liability or cost to itself at any time cancel or terminate the passenger’s bookings and in particular without limiting the generality of the aforegoing it shall be entitled to do so in the event of the illness or the illegal or incompatible behaviour of the passenger, who shall in such circumstances not be entitled to any refund.

The person making any booking will, by the making of such booking, warrant that he or she has the authority to enter into a contract on behalf of the other person included in such a booking and in the event of the failure of any or all of the other persons so included to make payment, the person making the booking shall by his/her signature thereof assume personal liability for the total price of all bookings made by him or her.

9. Changes to schedules     

Although every effort is made to adhere to schedules, it should be borne in mind that the Company reserves the right and in fact is obliged to occasionally change routes and accommodation on tours as dictated by changing conditions. Such conditions may be brought about by reservation problems, group decisions, local political conditions, flight cancellations, mechanical breakdown, weather, sickness, force majeure or any other unforeseen circumstances.

10. Insurance

You must take out comprehensive insurance cover when paying your deposit, to cover your cancellation, personal accident, medical expenses, personal baggage, emergency evacuation and money. You also agree to indemnify us against all third party claims, actions, damages and remedies which may be brought against us in respect of your participation in the tour.

11. Refunds

Whilst the company shall endeavour to ensure that all anticipated accommodation is available, there shall be no claim of any nature whatsoever against the Company, for a refund either in the whole or part, if any accommodation or excursion is not available or the passenger was unable to use that service.

12. Prices

Prices in this brochure are based on costs and exchange rates as at March 2007. However the cost of your holiday is subject t variations based on: fluctuations in transportation costs (fuel), fees of service providers, government action such as an increase in VAT, or any other government–imposed increase, or exchange rates.

Even in this case we will absorb an amount equal to 2% of the holiday price which excludes insurance premiums and any amendment changes. Only amounts in excess of this 2% will be surcharged.  We will not impose any surcharge within 30 days of departure. Similarly, the Company also reserves the right to decrease the tour price.

13. Not included  

The airfare to and from your tour destination, insurance, any surcharge, airport taxes, departure taxes, passport, vaccination and visa fees, telephone calls and faxes made on tour, alcohol and beverages, meals not detailed in the itinerary, tips, items of a personal nature, excess baggage, optional excursions, and airport transfers if you flight is more than a day earlier than the scheduled starting date of the tour.

14. Consent

The payment of the deposit OR any other partial payment for the reservation on the tour constitutes consent to all provisions of the conditions and general information contained in this brochure. The terms under which you agree to take the tour, cannot be changed or amended except in writing signed by an authorized member of the Company.

15. Delays

Our responsibility commences once you have joined the tour, and we cannot be held liable for any delays due to airlines and other operators not running to schedule. We shall not be responsible for any costs incurred in meeting up with the tour.  Any independent arrangements that you make which are not part of the tour, are entirely at your own risk. However, the Company will be available to assist, in the event of such delays.

General

Photography: The Company reserves the right without notice to make use of any photograph or film taken on the tour for general publicity purposes without payment or permission. We guarantee that no photographs of a compromising nature will be used.

Guides: If one of our guides is unable to take the tour, or continue due to illness, we reserve the right to substitute with another guide.

Brochure: The brochure is correct at the time of printing. We cannot be held responsible for any changes or inaccuracies which may occur after printing.

Special Requests: Special dietary requirements should be made to the agent when the client makes the booking or directly to the Company. The Company will attempt to provide any special requests.  This however cannot be guaranteed.

Agreement: This agreement is made subject to and shall be governed by, and constituted according to the laws of the Republic of South Africa.

Travelling with Sun Tours implies acceptance of these booking conditions.
